Terms of Service

Welcome to HandBook! These Terms of Service ("Terms") govern your access to and use of the HandBook mobile application ("App"), provided by HandBook LLC ("HandBook," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

1. Acceptance of Terms

By creating an account, accessing, or using HandBook, you confirm your agreement to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the App, including users who upload content, access community features, and use other functionalities.

2. Eligibility and User Accounts

  • Age Restriction: HandBook is intended for users aged 13 and older. We do not knowingly permit users under the age of 13 to create accounts or use the App. If we become aware that a user is under 13, we will take prompt steps to terminate the account and remove any associated data.

  • Account Creation: To access certain features of the App, you will be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

  • Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify HandBook immediately of any unauthorized use of your account. HandBook will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3. Your Content and Permissions

  • User-Generated Content (UGC): HandBook allows you to upload photos, post comments, and engage in other community features. Any content you create, submit, post, or display on or through the App is considered User-Generated Content ("UGC"). You retain all rights in, and are solely responsible for, the UGC you post to HandBook.

  • License to HandBook: By posting UGC on HandBook, you grant HandBook a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your UGC on HandBook solely for the purposes of operating, developing, providing, and using the HandBook App. This license will terminate when you delete your UGC or your account, unless your UGC has been shared with others who have not deleted it.

  • Photo and Camera Access: The App may require access to your device's camera and photo library to enable certain functionalities, such as uploading photos. By using these features, you grant HandBook permission to access your device's camera and photo library.

  • Data Entry: The App allows for data entry. You are responsible for the accuracy and legality of all data you enter into the App.

  • Inappropriate Content: While HandBook strives to maintain a safe and respectful community, we cannot guarantee that all UGC will comply with our guidelines at all times. You acknowledge and accept the risk that you may encounter content you find offensive or inappropriate. We encourage you to report any such content that violates our Community Guidelines.

4. Community Guidelines and Prohibited Conduct

You agree to use HandBook responsibly and to comply with all applicable laws and regulations. You agree not to engage in any of the following prohibited activities:

  • Posting content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

  • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

  • Uploading, posting, or otherwise transmitting any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.

  • Interfering with or disrupting the App or servers or networks connected to the App.

  • Attempting to gain unauthorized access to any portion of the App or any other accounts, computer systems, or networks connected to the App, whether through hacking, password mining, or any other means.

  • Using the App for any illegal or unauthorized purpose.

  • Harassing, abusing, or harming another person or group.

5. Content Moderation and Reporting

HandBook reserves the right to review, monitor, and remove any UGC that we deem to be in violation of these Terms or our Community Guidelines, in our sole discretion. We do not, however, undertake any obligation to monitor all UGC.

If you encounter content that you believe violates these Terms or is otherwise inappropriate, you may report it using the in-app reporting tools or by contacting us at info@handbooknails.com. We will investigate reports and take appropriate action as necessary.

6. Intellectual Property Rights

  • HandBook's Rights: All rights, title, and interest in and to the App (excluding UGC) are and will remain the exclusive property of HandBook LLC and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in these Terms gives you a right to use the HandBook name or any of the HandBook trademarks, logos, domain names, and other distinctive brand features.

  • Your Rights: You retain all ownership rights in your UGC.

7. Third-Party Links and Services

The App may contain links to third-party websites or services that are not owned or controlled by HandBook. HandBook has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that HandBook shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "as available" basis. HandBook makes no warranties, express or implied, regarding the App, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. HandBook does not warrant that the App will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by applicable law, HandBook LLC, its affiliates, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Indemnification

You agree to defend, indemnify, and hold harmless HandBook LLC and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; b) a breach of these Terms; or c) content posted by you on the App.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of South Carolina, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts located in North Charleston, South Carolina.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.

13. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the App.

14. App Store Platforms

If you downloaded HandBook through Apple's App Store, you acknowledge that these Terms are entered into between you and HandBook LLC only, and not with Apple Inc. Apple is not responsible for the App or its content, and has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Apple provides no warranty for the App, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty are HandBook LLC's sole responsibility. Apple has no responsibility for addressing any claims by you or any third party relating to the App or your use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. You acknowledge and agree that Apple is a third-party beneficiary of these Terms and that, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
